Minnesota Vikings defensive coordinator Brian Flores got a big win in federal appeals court, as the U.S. Second Circuit Court of Appeals sided with a New York district court ruling, which allows his lawsuit to go to trial. It’s a big win for Flores, as a trial will reveal more than arbitration.

Flores getting his day in court is huge, as it will compel the National Football League, along with the Houston Texans, New York Giants, and Denver Broncos to be cooperative. Discovery, where all the evidence is turned over, will end up being really interesting. ESPN’s piece on the story revealed some interesting quotes from the appeals court.

The 2nd Circuit said the NFL constitution’s arbitration provision “contractually provides for no independent arbitral forum, no bilateral dispute resolution, and no procedure.”

“Instead, it offends basic presumptions of our arbitration jurisprudence” by forcing claims to be decided by the NFL’s “principal executive officer,” the appeals court said.

The reason Flores is suing the NFL is a simple one: discriminatory hiring practices. It’s going to be interesting to see how this continues to develop, including if the NFL takes this to the supreme court.
